1. Scope of Application

These terms of use apply to the use of the CountTogether website and application. By using our service, you agree to these terms.

2. Service Description

CountTogether is a freemium service that allows users to create, manage and share counters. The basic service is available for free. Additional Pro features can be unlocked through in-app purchases. The service works without registration and enables real-time synchronization between multiple participants.

3. Usage Rules

When using CountTogether, you commit to:

  • Use the service only for legal purposes
  • Not create offensive, discriminatory or illegal content
  • Respect the rights of other users
  • Not engage in spam or abuse activities
  • Not use the service for commercial purposes without permission

4. Public Counter Pages

Users have the option to create and publish public counter pages.

The user is solely responsible for all content on these pages, in particular for the name of the counter and the description.

It is prohibited to use content that is offensive, discriminatory, racist, pornographic, glorifying violence, politically extremist, or otherwise objectionable or unlawful.

Content that violates applicable law or public morality is also prohibited.

The operator reserves the right to review, restrict or remove public counter pages at any time without stating reasons.

In the event of violations of these guidelines, individual content may be removed, public counter pages may be deactivated, or the user's entire account may be temporarily or permanently suspended.

There is no entitlement to the restoration of deleted content or blocked pages.

Repeated or serious violations may result in the permanent suspension of the user account.

5. Availability

We strive for high availability of the service, but cannot guarantee 100% availability. Maintenance work and technical problems can lead to temporary outages.

6. Push Notifications

The CountTogether app may send push notifications to inform users about certain events (e.g., counter milestones or updates to shared counters). However, the delivery of push notifications is not guaranteed. Due to technical issues, network conditions, device settings, or other circumstances beyond our control, push notifications may fail to be delivered or may be delayed.

CountTogether assumes no liability for any damages or disadvantages arising from the non-delivery, delayed delivery, or incorrect delivery of push notifications.

7. Home Screen Widgets

The CountTogether app offers home screen widgets that display counter information. The accuracy and timeliness of the data shown in widgets depends on factors such as internet connectivity, device settings, and operating system restrictions. CountTogether does not guarantee that widgets will always display current or accurate data.

CountTogether assumes no liability for any damages or disadvantages arising from inaccurate, outdated, or unavailable widget data.

8. Profile Pictures

Users have the option to upload a profile picture to personalize their profile within the app.

Profile pictures are generally only visible to other members of the same counter. However, the images are not technically protected by authentication. Therefore, it cannot be completely excluded that profile pictures may be viewed by third parties via direct links or random access.

The following content guidelines apply to uploaded profile pictures:

  • Uploading profile pictures with sexual, pornographic, or suggestive content is prohibited
  • Depictions glorifying violence or degrading human dignity are prohibited
  • Radical, extremist, or politically extremist symbols, signs, or content are prohibited
  • Legally prohibited symbols, signs, or content may not be used

The operator reserves the right to remove profile pictures that violate these guidelines without prior notice.

In case of violations of these content guidelines, further measures may be taken, including warnings, temporary suspension, or permanent suspension of the user account.

9. Data Storage

CountTogether only stores counter data temporarily. Inactive counters are automatically deleted after a certain time. Permanent storage is not guaranteed.

10. Third-Party Services

The CountTogether app uses the following third-party services:

Sentry Error Monitoring

To improve app stability and fix technical issues, we use Sentry for error monitoring. This service collects technical error information when the app encounters problems. No personal data is transmitted to Sentry - only technical error details that help us diagnose and fix issues.

11. Disclaimer

The service is provided "as is". We do not guarantee the completeness, accuracy or availability of the information and functions provided.

Use is at your own risk. We are not liable for damage caused by the use or non-use of the service, unless this is based on intentional or grossly negligent behavior on our part.

12. Changes to Terms of Use

We reserve the right to change these terms of use at any time. Changes will be published on this page and take effect upon publication.

13. Termination

You can terminate use at any time. We reserve the right to block access for users who violate these terms.

14. Applicable Law

These terms of use are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Niederkassel, Germany.
